I recently presented a study for the Environmental Bankers Association Risk Management Committee entitled “How Do RECs Slip Through the Cracks?” As the CEO of Partner Engineering and Science, a national due diligence and engineering consultancy, and as a registered civil engineer, I have overseen thousands of environmental due diligence assessments. There are many reasons errors and missed RECs occur, from improper due diligence, to lenders not requiring a full Phase I Environmental Site Assessment, to risk interpretation between transaction stakeholders. It is important to understand the full scope of environmental assessments based on lender need, current regulations, and risk tolerance.
